1. What is this lawsuit about?

A lawsuit under California’s Private Attorney General Act (“PAGA”) has been filed by Joseph Shepler (“Plaintiff”), a former employee of the Board of Trustees of the California State University (“CSU”). This is not a lawsuit against you, and you are not being sued.

The lawsuit is entitled Shepler v. The Board of Trustees of the California State University and is pending in the Superior Court for the State of California, County of Los Angeles, Case No. BC705095. CSU denies all the allegations made by Mr. Shepler and maintains that it has complied with all applicable laws.

2. Why did I receive a notice?

The notice is approved by the Court and is designed to give you an opportunity to object to the disclosure of your email address, phone number and address. Mr. Shepler filed the lawsuit to recover penalties on behalf of other CSU employees whom he believes are similarly situated for alleged violations of health and safety regulations and statutes at the CSU campuses.

3. What personal information would potentially be disclosed and how would it be used?

The Court has ordered CSU to provide your last known email address, address and telephone number(s), and your job title and department where you were employed at CSU, to Mr. Shepler’s attorneys. However, before any of your information is provided, the notice is delivered in order to provide you with an opportunity to object to the disclosure of your information. You should know that Plaintiff and his attorneys have agreed to use your contact information only for purposes of the lawsuit and have agreed not to disclose your contact information to anyone who is not a participant in the lawsuit.

4. How do I potentially participate in this lawsuit?

If you wish for your email, address and telephone number, and your job title and department where you were employed at CSU, to be disclosed to Plaintiff and his attorneys, you do not need to do anything.

5. What if I do not want any of my personal information disclosed?

If you do not want your email, address and telephone number disclosed to Plaintiff and his attorneys, you must alert the Notice Administrator as directed in your notice.

If you received the notice by email, you must alert the Notice Administrator by selecting the “opt-out” link in that email or on this website. You will need your SIMID and UNIQUE ID located in the notice that was sent to opt-out electronically.

6. Is the notice a communication from the Court?

The notice is not a communication from the Court and is not an expression of any opinion by the Court as to the merits of the claims or defenses by either side. Please do not contact the Court or the clerk of the court.
